Private residential development briefing – Planning update: Biodiversity net gain and the impact of nitrates, phosphates and air quality on new development

Trowers & Hamlins are delighted to team up with ecology consultants BioGains to bring you up to date with the Government's plans to introduce biodiversity net gain requirements for new development. This is set to become a big issue in the next 12 to 24 months. 

Primary legislation setting the framework for biodiversity net gain received royal assent in November 2021 and the Government is consulting on the regulations that will implement the biodiversity net gain requirements.

Planning partner Rory Stracey will take a look at the key legal issues that will  be central in the biodiversity net gain requirements, whilst Jon Garner of BioGains will talk about how it will work in practice, and what role ecologists will need to play in discharging the net gain requirement. We will also be joined by our Environmental law specialist Helen Mitcheson who will look into recent developments in the field of nitrates, phosphates and air quality in the planning system.
